Welcome to Racewear. These Terms & Conditions ("Terms") govern your access to and use of the Racewear website, products, services, and related offerings.
By accessing our website, creating an account, submitting an order, requesting a quote, or purchasing products or services from Racewear, you agree to these Terms. If you do not agree, please do not use our website or services.
1. About Racewear
Racewear provides products and solutions for businesses, organizations, government customers, and individual purchasers. Our product offerings may include commercial fitness equipment, warehouse and material-handling equipment, office products and furniture, safety and PPE products, commercial electronics, facility maintenance products, and other business-related merchandise.
Products may be stocked, distributed, shipped, manufactured, or fulfilled by Racewear or third-party manufacturers, distributors, suppliers, and fulfillment partners.
2. Eligibility
You must be legally capable of entering into a binding agreement to make a purchase through Racewear.
If you make a purchase on behalf of a company, government agency, organization, or other entity, you represent that you have authority to make the purchase and bind that entity to the applicable transaction.
3. Product Information
Racewear makes reasonable efforts to provide accurate product descriptions, specifications, photographs, availability, measurements, and other information.
However, manufacturers and suppliers may modify products, packaging, specifications, model numbers, or other characteristics without notice.
Product images may be provided for illustrative purposes. Actual colors, packaging, accessories, dimensions, or appearance may vary.
Customers are responsible for reviewing product specifications and confirming that a product is appropriate for its intended application before purchasing.
4. Pricing
All prices displayed on our website are subject to change without notice unless otherwise stated in a written quotation or agreement.
We make reasonable efforts to maintain accurate pricing. However, typographical, technical, supplier, or pricing errors may occasionally occur.
Racewear reserves the right, to the extent permitted by law, to correct errors and cancel or decline an order affected by a material pricing or product-information error. If payment has already been collected for an order that we cancel, the applicable amount will be refunded.
5. Orders
Submitting an order does not necessarily constitute final acceptance by Racewear.
Orders may be subject to payment authorization, product availability, fraud screening, supplier confirmation, shipping availability, or other verification.
Racewear reserves the right to decline or cancel an order when reasonably necessary, including because of:
- Product unavailability
- Pricing or listing errors
- Payment authorization problems
- Suspected fraud or unauthorized transactions
- Shipping or delivery restrictions
- Supplier or manufacturer limitations
- Legal or regulatory requirements
If we cancel a paid order, we will issue an appropriate refund for the canceled merchandise.
6. Payment
Customers agree to provide current, complete, and accurate billing and payment information.
Available payment methods may vary and may include credit cards, debit cards, electronic payments, approved business payment arrangements, financing, or other methods displayed during checkout or approved by Racewear.
Customers authorize Racewear and its payment-processing providers to charge the payment method provided for authorized purchases, including applicable taxes, shipping, freight, and other disclosed charges.
7. Business Financing and Payment Terms
Racewear may make financing, business credit, trade credit, Net terms, lease-to-own arrangements, or other payment solutions available to qualifying customers.
Unless Racewear expressly states otherwise, financing or credit products may be provided by independent third-party financial institutions or service providers.
Approval is not guaranteed and may depend on the provider's eligibility requirements, underwriting criteria, credit requirements, documentation, and other factors.
The terms of any financing or credit agreement are governed by the applicable agreement between the customer and financing provider.
Racewear does not guarantee that using a financing or payment product will establish, improve, or increase a customer's business or personal credit score.
8. Taxes
Customers are responsible for applicable sales, use, excise, or other taxes associated with their purchases unless a valid exemption applies.
Tax-exempt organizations and government customers may be required to provide appropriate documentation before tax-exempt treatment can be applied.
9. Shipping & Delivery
Shipping and delivery estimates are estimates and are not guaranteed unless Racewear expressly provides a written delivery guarantee.
Delivery may be affected by carriers, manufacturers, suppliers, weather, inventory availability, freight schedules, supply-chain disruptions, or circumstances outside our reasonable control.
Some commercial and oversized products may require:
- Freight delivery
- Scheduled delivery appointments
- Lift-gate service
- Loading-dock access
- Commercial delivery locations
- Inside-delivery services
- Additional handling or installation arrangements
Customers are responsible for providing accurate delivery information and ensuring that the delivery location can safely receive the merchandise ordered.
Additional charges resulting from incorrect addresses, failed delivery attempts, inaccessible delivery locations, storage, redelivery, or customer-requested services may be charged to the customer where permitted.
10. Freight Shipments
Customers should inspect freight shipments upon delivery.
Visible damage should be documented on the carrier's delivery receipt before the driver leaves whenever reasonably possible. Customers should photograph damaged merchandise and packaging and promptly contact Racewear.
Concealed damage discovered after delivery should also be reported promptly so we can assist with any available carrier or supplier claim.
11. Returns & Refunds
Racewear offers eligible returns within 30 days of delivery, subject to our Return & Refund Policy.
Products generally must be returned in their original or otherwise resalable condition and include applicable components and accessories.
Return shipping, freight charges, and restocking fees may apply depending on the circumstances of the return.
Damaged, defective, or incorrectly shipped merchandise will be handled according to our Return & Refund Policy and applicable law.
The Racewear Return & Refund Policy is incorporated into these Terms by reference.
12. Order Cancellations
Customers should contact Racewear as soon as possible if they need to cancel an order.
We cannot guarantee cancellation after an order has entered processing, been submitted to a supplier, prepared for shipment, or shipped.
Orders that cannot be canceled may be subject to our Return & Refund Policy after delivery.
13. Bulk, Commercial & Government Orders
Racewear may accept bulk, wholesale, corporate, institutional, educational, and government purchases.
Large orders may require separate quotations, purchase orders, deposits, payment arrangements, freight terms, or written agreements.
If a separately executed written agreement expressly conflicts with these Terms, the separately executed agreement will control with respect to that transaction to the extent of the conflict.
14. Purchase Orders
Racewear may accept purchase orders from approved business, institutional, or government customers.
Submission of a purchase order does not guarantee acceptance.
Any additional or conflicting terms printed on a customer's purchase order will not modify these Terms unless expressly accepted in writing by an authorized representative of Racewear.
15. Product Warranties
Certain products may include warranties provided by their respective manufacturers.
Unless expressly stated otherwise in writing, manufacturer warranties are provided by the applicable manufacturer and are subject to that manufacturer's warranty terms, exclusions, procedures, and limitations.
Racewear may assist customers with obtaining manufacturer warranty information when reasonably available.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
16. Installation & Product Use
Customers are responsible for ensuring products are properly assembled, installed, maintained, operated, and used according to manufacturer instructions and applicable safety requirements.
Commercial equipment should be installed or serviced by qualified personnel when required by the manufacturer or applicable law.
Racewear is not responsible for damage or injury caused by improper installation, misuse, unauthorized modification, failure to follow manufacturer instructions, or use of a product for an unintended purpose, except to the extent liability cannot legally be excluded.
17. Website Accounts
Customers may be permitted to create online accounts.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account to the extent permitted by law.
Please contact Racewear promptly if you believe your account or payment information has been accessed without authorization.
18. Intellectual Property
The Racewear name, branding, website design, graphics, written materials, and original content owned by Racewear are protected by applicable intellectual-property laws.
Third-party trademarks, product names, photographs, logos, and other intellectual property remain the property of their respective owners.
Nothing on our website grants user's ownership of Racewear or third-party intellectual property.
19. Prohibited Uses
Customers and website visitors may not use our website to engage in fraudulent, unlawful, abusive, or harmful conduct.
This includes attempting to interfere with website security, accessing restricted systems without authorization, submitting fraudulent transactions, impersonating another person or organization, or using website content in violation of applicable intellectual-property laws.

Manufacturer warranties, when applicable, remain subject to the manufacturer's terms.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Racewear will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, products, or services.
Where legally permitted, Racewear's aggregate liability arising from a particular purchase will not exceed the amount actually paid to Racewear for the product or service giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.

Nothing in this section prevents either party from exercising rights or remedies that cannot legally be waived.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
30. No Waiver
Failure by Racewear to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

Racewear may update these Terms periodically.
Changes will be posted on our website with an updated "Last Updated" date. Changes will apply prospectively as permitted by applicable law.
