Welcome to Racewear. These Terms of Service (“Terms”) govern your use of the Racewear website, purchase of products, request or purchase of loading and unloading services, and other transactions or interactions with Racewear.

By accessing our website, placing an order, requesting a quote, approving an invoice or service request, scheduling services, or otherwise doing business with Racewear, you agree to these Terms.

1. About Racewear

Racewear is a business-to-business provider of commercial products and warehouse support services.

Our retail offerings may include warehouse and facility equipment, safety and PPE products, office furniture and supplies, commercial electronics, facility maintenance products, and other products intended primarily for commercial and business use.

Our logistics and labor services may include:

• Truck and trailer loading and unloading

• Shipping container loading and unloading

• Warehouse labor

• Material and freight handling

• Pallet handling

• Order pulling and related warehouse assistance

• Other commercial labor and logistics support services

The availability of particular products and services may vary by location and customer requirements.

2. Business Customers

Racewear primarily serves businesses, warehouses, distribution centers, logistics operations, commercial facilities, government organizations, and other commercial customers.

By placing an order or requesting services on behalf of a company or organization, you represent that you have authority to make the purchase, approve the service, or otherwise enter into the transaction on behalf of that organization.

3. Product Orders

Product availability, descriptions, specifications, photographs, pricing, and estimated delivery information may change periodically.

Racewear makes reasonable efforts to provide accurate product information. However, manufacturers, distributors, suppliers, and fulfillment partners may change product specifications, packaging, availability, or other details without notice.

We reserve the right to correct errors, update information, cancel unavailable products, or decline an order when reasonably necessary.

4. Product Pricing

Product prices are displayed on the website or provided through a quote or invoice.

Prices may change without notice prior to an order being accepted. Applicable shipping charges, taxes, delivery fees, special handling charges, or other disclosed charges may be added to the purchase price.

For quoted commercial orders, pricing may depend on quantity, product availability, freight requirements, destination, and other order-specific circumstances.

5. Shipping & Fulfillment

Physical products may be shipped directly by Racewear or through manufacturers, distributors, suppliers, warehouses, or other fulfillment partners.

Shipping and delivery estimates are provided in good faith but are not guarantees unless Racewear expressly agrees otherwise in writing.

Delivery may be affected by carrier delays, supplier availability, weather, transportation disruptions, incorrect customer information, or circumstances outside Racewear's reasonable control.

Customers are responsible for providing complete and accurate shipping and delivery information.

6. Loading, Unloading & Warehouse Services

Customers requesting loading, unloading, or warehouse labor services must provide reasonably accurate information regarding the job, including the location, requested date and time, freight or material involved, trailer or container information, estimated workload, facility requirements, and any known safety or access requirements.

Service pricing may be determined based on factors including:

• Scope and type of work

• Number of workers required

• Expected job duration

• Freight quantity and characteristics

• Container or trailer size

• Equipment requirements

• Location and travel requirements

• Scheduling requirements

• Additional services requested

Racewear may provide a quote, work order, service agreement, invoice, or other documentation before work begins.

7. Customer Approval

Customers are responsible for reviewing quotes, invoices, work orders, service descriptions, and applicable charges before approving a transaction.

Approval may be provided electronically, through an accepted quote or invoice, through a payment authorization, by signature, or through another mutually accepted method.

Changes to the scope of work requested after the original approval may result in additional charges.

8. Payment Authorization

Racewear may require a valid payment method before products are shipped or services are scheduled or performed.

For certain service transactions, Racewear may place a temporary authorization or pre-authorization on the customer's payment method before work begins. A payment authorization is not necessarily the final charge.

The final amount may reflect the approved services actually performed, additional authorized work, applicable fees, taxes, or other agreed charges.

Racewear will process payments in accordance with the customer's authorization and applicable payment-network requirements.

9. Invoices & Payment

Customers are responsible for paying invoices according to the payment terms stated on the applicable invoice, quote, service agreement, or other transaction documentation.

Racewear may suspend future services, decline additional orders, or require advance payment when an account has an overdue balance.

Customers should promptly contact Racewear if they believe an invoice or payment contains an error.

10. Cancellations & Rescheduling

Customers should provide Racewear with reasonable notice when cancelling or rescheduling loading, unloading, or warehouse labor services.

Depending on the circumstances and the terms disclosed for the particular job, charges may apply when workers have already been scheduled, dispatched, arrived at the facility, or begun performing work.

Any applicable cancellation, dispatch, minimum-service, or other fees will be handled according to the customer's applicable quote, service agreement, invoice, or other agreed terms.

11. Customer Responsibilities for Service Locations

Customers requesting on-site services are responsible for providing a reasonably safe and accessible work environment.

Customers should disclose known hazards, facility requirements, PPE requirements, restricted areas, special handling requirements, and other conditions reasonably necessary for Racewear personnel to perform the requested work.

Customers are also responsible for ensuring Racewear personnel have appropriate authorization and access to the work location at the scheduled time.

Racewear may pause, refuse, or discontinue work when conditions present an unreasonable safety risk or prevent the requested services from being performed.

12. Service Completion

Racewear will make reasonable efforts to perform services professionally and according to the agreed scope of work.

Completion times may vary because of freight conditions, facility delays, equipment availability, access restrictions, customer-requested changes, unexpected workload, weather, or other circumstances.

Completed labor and services cannot be physically returned. Refunds or adjustments involving services are therefore handled according to Racewear's Return, Refund & Service Cancellation Policy and the circumstances of the particular transaction.

13. Returns & Refunds

Eligible physical products may be returned according to Racewear's posted Return, Refund & Service Cancellation Policy.

Certain products, including customized, special-order, used, installed, opened safety-related products, or merchandise specifically designated as non-returnable, may be subject to additional restrictions.

Service refunds, billing adjustments, and cancellations are handled separately because of the labor-based nature of the services.

14. Fraud Prevention & Transaction Review

Racewear reserves the right to review orders, payments, service requests, and customer information for fraud prevention, payment security, and business-risk purposes.

We may request reasonable additional information before accepting or completing certain transactions.

Racewear may decline or cancel a transaction when we reasonably believe it involves fraud, unauthorized payment activity, materially inaccurate information, prohibited activity, or an unacceptable payment or operational risk.

15. Website Use

You agree not to use the Racewear website:

• For fraudulent or unlawful purposes

• To submit false or misleading information

• To interfere with the operation or security of the website

• To attempt unauthorized access to Racewear systems or accounts

• To violate another person's or company's intellectual property or other legal rights

Racewear may restrict access to the website when reasonably necessary to protect customers, Racewear, or our systems.

Racewear does not guarantee uninterrupted website availability, exact delivery dates, or results that depend on circumstances outside our reasonable control.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Racewear will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use of our website, products, or services.

Racewear's liability for a particular transaction will be subject to applicable law and any additional written agreement governing that transaction.

Racewear will not be responsible for delays or failures caused by circumstances reasonably beyond our control, including severe weather, natural disasters, transportation interruptions, labor disruptions, government actions, utility or telecommunications failures, supplier interruptions, facility closures, or similar events.

Payment information may also be processed by third-party payment providers according to their applicable privacy and security practices.
